The ‘no-suicide contract’ is a frequently utilized tool in both the assessment and dispersal of suicidal patients. However, little attention has been given to questioning whether suicidal persons are able to give informed consent to enter such a contract. This article utilizes both the existing literature on no-suicide contracts and the results of recent research into the effects of this tool, to examine whether its use is consistent with the legal and ethical doctrine of informed consent. Particular attention is given (...) to issues of competence, fullness of information, voluntariness and paternalistic intervention when no-suicide contracts are used. This analysis finds the tool to be problematic and suggests that individual patients’ ability to give informed consent about a no-suicide contract needs to be carefully considered by clinicians. In our contemporary post-modern context, it has become increasingly awkward to talk about a good that is shared by all. This is particularly true in the context of mammoth multi-national corporations operating in global markets. Nevertheless, it is precisely some of these same enormous, aggrandizing forces that have given rise to recent corporate scandals. These, in turn, raise questions about ethical systems that are focused too myopically on self-interest, or the interest of specific groups, locations or cultures. The obvious traditional (...) alternative to moral bellybutton gazing is the common good, which challenges the modern business enterprise to realize non-instrumental values that can only be attained in our life together. The common good dictates that leadership should be judged, first of all, according to moral criteria rather than professional competence. It helps correct the distorted prioritization of the maximization of profit in every business decision, recognizing that businesses have a multitude of rights and responsibilities, and the common good reminds us that the first of these is not always profit-making. It includes personal and emotional dimensions, as I'm sure it will for many readers.This book is an attempt to understand modern adoptive practices from a primarily Christian/Catholic perspective, with helpful allusions to the beliefs and practices of the other Abrahamic faiths. Overall, I believe the book succeeds in presenting a solid theological foundation for adoption in general and, more specifically, for its current mainstream manifestation in the developed world. The author doesn't shy away from the various controversies related to adoption—like assisted reproduction, LGBTQ adoption, embryo adoption—and he takes on other authors who make claims about adoption that he believes distract or obscure the central purpose of adoption, which is to provide a child a "needed place of belonging" within the network of loving relationships that is the ideal of the family (38).My reservations about the book are two. The first has to do with the inconsistent tone of the book, which tends to swing, abruptly at times, from a theological and analytical tone to one that feels more popular and homiletic—even to the point of being maudlin. As stated earlier, I have high regard for most of the analytical sections and find the overarching thesis convincing. Generally, in these sections, the method begins with the lived experience of adoptees and their parents and works through scripture, tradition, and critical reflection to arrive at a reasonable conclusion. However, occasionally the book drifts into uncritical and merely emotive territory, and this is especially the case in the sections called "interludes," where the author presents letters to adoptees from their parents reprinted from the Christian Century magazine. These seem out of place and even distracting. Of even greater concern is the concluding chapter, where the author should be summarizing and highlighting the strengths of his thesis. Instead he chose to draw homiletic lessons from Anne of Green Gables (110).My second reservation is not so much a critique of this book but of the state of contemporary Catholic sexual ethics, which forms a backdrop for the entire book. The book accurately reflects a mainstream position in Catholic sexual ethics, which abandoned a narrow focus on procreation decades ago in favor of one highlighting the unitive and relational aspects of human intimacy. This move away from a strictly deontological framework stressing the duty to procreate and toward a teleological ethic stressing the need to model human relationships after divine ones has been celebrated for good reasons, but it has not come without costs. Like all teleological ideals, this sexual ethic is attractive to purveyors of high philosophy but tends to be thoroughly abstract and almost entirely incapable of offering concrete, practical guidance. Because it is so abstract, its application to specific moral issues can seem arbitrary and at the whim of the author. Such is the case in this book, for instance, when this teleological ideal is wielded to shed doubt on LGBTQ adoption. It is particularly telling [End Page 210] that the author neglects to consult lived experience in this section, ignoring the mountains of evidence readily available that LGBTQ families can be just as loving and nurturing as those of traditional families. A Reflection On The Question Of God's Existence In Contemporary Thomistic Metaphysics, Texts And Studies, V1. The Thomist, V23, No. 1-3.

Gilead et al.'s theory presupposes that traversing temporal, spatial, social, and hypothetical distances are largely interchangeable acts of mental travel that co-occur in human ontogeny. Yet, this claim is at odds with recent developmental data suggesting that children's reasoning is differentially affected by the dimension which they must traverse, and that different representational abilities underlie travel across different dimensions.

In this paper I want to propose that we see solipsism as arising from certain problems we have about identifying ourselves as subjects in an objective world. The discussion will centre on Wittgenstein’s treatment of solipsism in his Tractatus Logico- Philosophicus. In that work Wittgenstein can be seen to express an unusually profound understanding of the problems faced in trying to give an account of how we, who are subjects, identify ourselves as objects in the world. We have in his (...) compressed remarks, the kernels of a number of arguments which all come together to form what can be called the problem of self-identification. I want to argue that the solipsism of the Tractatus arises at least in part as a solution to, or – to put it less optimistically – as a symptom or articulation of this problem. In approaching Wittgenstein’s early discussion of solipsism in this way I will obviously be in disagreement with some other interpretations of the work. For example, there are those who think that there is no ‘solipsism of the Tractatus’.1 In fact, the Tractarian arguments presented below as motivating solipsism have been seen as fulfilling the quite opposite function of refuting it. I do not intend in this piece to engage with alternative interpretations. Let me say a little bit about why I have granted myself the licence not to do so. First, the focus of my concern with solipsism is on how it connects with what I have called the problem of self-identification. Using the linearized Einstein gravitational field equations and the Maxwell field equations it is shown that the plane of polarization of an electromagnetic wave is rotated by the gravitational field created by the electromagnetic radiation of a ring laser. It is further shown that this gravitational Faraday effect shares many of the properties of the standard electromagnetic Faraday effect. An experimental arrangement is then suggested for the observation of this gravitational Faraday effect induced by the ring laser.

Coauthored scholarship increased substantially across fields of science during the twentieth century, but it is unclear whether this growth reflects change in the behavior of individual scientists or publishing differences between cohorts of researchers. I examine the publication records of an interdisciplinary sample of university scientists and find evidence of both career-aging and cohort-succession processes, although cohort differences are much more pronounced than individual changes. Specifically, scientists in this sample increased the percentage of their articles with coauthors by 0.63 percentage (...) points annually. However, compared to those who received their PhDs between 1953 and 1962, scientists who entered the workforce between 1983 and 1991 coauthored approximately one third more of their early career articles. Additionally, career-aging processes in coauthorship varied by PhD cohort, with earlier trained researchers increasing more rapidly. Overall, this article highlights cohort succession as a source of change in coauthorship, and underscores the importance of accounting for generational differences in studies of scientific careers. The “New Natural Law” Theory (NNL) of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators offers a distinctive account of intentional action, which underlies a moral theory that aims to justify many aspects of traditional morality and Catholic doctrine. -/- In fact, we show that the NNL is committed to premises that entail the permissibility of many actions that are irreconcilable with traditional morality and Catholic doctrine, such as elective abortions. These consequences follow principally from two aspects of the (...) NNL. The first aspect is its distinctive version of the planning theory of intention, in which adopting the 'first-person perspective' of an agent is a sufficient, and not merely necessary, condition for determining the nature of his intentional action; this planning theory rests upon an implicitly Cartesian conception of human behavior, in which behavior chosen by an agent has no intrinsic “intentionalness” apart from what he confers upon it as part of his plan. The second aspect is the NNL's distinctive account of basic human goods' incommensurability, according to which there is no common factor shared by basic human goods that allows them to be comparatively ranked in any way that directs practical deliberation. -/- The entailments of these two aspects of the NNL, we argue, amount to a reductio ad absurdum. Pace the proponents of the NNL account, we sketch an alternative hylomorphic conception of intentional action that avoids untoward moral implications by grounding human agency in the exercise of basic powers that are either (a) essential constituents of human nature or (b) acquired through participation in social practices. This conception of intentional action provides a stronger foundation for natural law theory. (shrink)

John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational basis review (...) in terms of liberal neutrality akin to Rawls’s “public reason,” and overturned Proposition 8 and established same-sex marriage. (This reinterpretation was amplified in the 9th Circuit Court’s decision upholding the district court on appeal in Perry v. Brown.) But on its own grounds Perry should have drawn the opposite conclusion. This is because all the available arguments for recognizing same-sex unions as civil marriages stem from controversial comprehensive doctrines about the good, and this violates the ideal of public reason; yet there remains a publicly reasonable argument for traditional marriage, which I sketch here. In the course of my argument I develop Rawls’s politically liberal account of the family by drawing upon work by J. David Velleman and H. L. A. Hart, and discuss the implications of this account for political theory and constitutional law. (shrink)

The dossier contains: (1) a history, by Bill Foley, of the early collective efforts of a group of gay men to provoke government action and healthcare under the umbrella of Gay Health Action (GHA) (2) a speech delivered by Dr. Erin Nugent to government officials on the (...) re-branding of HIV Ireland in 2015; (3) a brief history, recounted by Noel Donnellan, of ACT UP Dublin since it was revitalized in 2016 by a small cohort of dedicated activists from a dormant group into a vibrant collective that has achieved great legislative change with regards to pre-exposure prophylaxis (PrEP); and (4) a polemic, written by Thomas Strong, on living with HIV as a queer man in Ireland that demonstrates the ways in which HIV stigma not only thrives in but molds and shapes twenty-first-century gay men’s communities, both in real life and online. Nursing Inquiry 2003; 10: 218–228Implementing evidence-based nursing practice: a tale of two intrapartum nursing unitsDespite concerns that the rise of evidence-based practice threatens to transform nursing practice into a performative exercise disciplined by scientific knowledge, others have found that scientific knowledge is by no means the preeminent source of knowledge within the dynamic settings of health-care. We argue that the contexts within which evidence-based innovations are implemented are as influential in the outcomes as (...) the individual practitioners who attempt these changes. A focused ethnography was done in follow-up to an earlier trial that evaluated the effectiveness of a marketing strategy to encourage the adoption of evidence-based intrapartum nursing practice. Bourdieu's (1990, 1991) concepts of habitus, capital and social field were used in our refinement of the analysis of the ethnographic findings. Nursing leadership, interprofessional struggle with physicians, the characteristics of the community and the physical environment were prominent issues at all of the sites. Detailed descriptions of the sociohistorical context and of the experiences at two sites are presented to illustrate the complexities encountered when implementing innovations. (shrink)

This article aims to describe underlying principles of paradigm shifts in clinical medicine by means of analysis of typical examples. Retrospectively, profound shifts of ruling paradigms can be shown in diverse fields such as outcome research, in the redefining of patient's and doctor's autonomies, in the challenges presented by consumer medicine and the free market economy. This has provoked controversy between doctors, patients and the community. The judgement on whether recent shifts in paradigms in medicine have improved the health care (...) delivered today is by no means uncontroversial. Aiming to demonstrate how shifts of paradigms in medicine occur and what consequences can result from such shifts we reflect on the works of Thomas S. Kuhn, the eminent philosopher of science. An analysis of his theories lends important insight into the observed shifts in paradigms. (shrink)

A contemporary debate concerning the epistemology of testimony is portrayed by its protagonists as having its origins in the eighteenth century and the respective views of David Hume and Thomas Reid. Hume is characterized as a reductionist and Reid as an anti-reductionist. This terminology has been widely adopted and the reductive approach has become synonymous with Hume. In Sect. 1 I spell out the reductionist interpretation of Hume in which the justification possessed by testimonially-acquired beliefs is reducible to the (...) epistemic properties of perception, memory and inductive inference. This account of testimony is taken to be found in the section ‘On Miracles’ of Hume’s Enquiry concerning Human Understanding. In Sect. 2 I introduce the distinction between global and local reductionism, and Coady’s interpretation of Hume as a global reductionist. He takes Hume’s position to be untenable. The rest of the paper explores alternative interpretations of Hume. Section 3 develops a local reductionist interpretation of Hume on testimony. It is argued, though, that such an approach is unstable and, in response, Sect. 4 turns to anti-reductionism in its contemporary forms and in Reid’s teleological account. In Sect. 5 I argue for an anti-reductionist account of Hume, one drawn from his discussion of the testimony of history in the Treatise of Human Nature, thus moving away from the usually exclusive focus upon the discussion of miracles in the first Enquiry, upon which the reductionist interpretation is based. Given the standard meaning of ‘Humeanism’ in the current debate, my interpretation amounts to the claim that Hume is not a Humean with respect to testimony. (shrink)

PurposeTo use the power of knowledge acquisition and machine learning in the development of a collaborative computer classification system based on the features of age-related macular degeneration (AMD).MethodsA vocabulary was acquired from four AMD experts who examined 100 ophthalmoscopic images. The vocabulary was analyzed, hierarchically structured, and incorporated into a collaborative computer classification system called IDOCS. Using this system, three of the experts examined images from a second set of digital images compiled from more than 1000 patients with AMD. Images (...) were annotated, and features were identified and defined. Decision trees, a machine learning method, were trained on the data collected and used to extract patterns. Interrelationships between the data from the different clinicians were investigated.ResultsSix drusen classes in the structured vocabulary were largely sufficient to describe all the identified features. The decision trees classified the data with 76.86% to 88.5% accuracy and distilled patterns in the form of hierarchical trees composed of 5 to 15 nodes. Experts were largely consistent in their characterization of soft, and to a lesser extent, hard drusen, but diverge in definition of other drusen. Size and crystalline morphology were the main determinants of drusen type across all experts.ConclusionsMachine learning is a powerful tool for the characterization of disease phenotypes. The creation of a defined feature set for AMD will facilitate the development of an IDOCS-based classification system. (shrink)
